LIABILITY WAIVER & MEDIA RELEASE AGREEMENT

This Liability Waiver and Media Release ("Agreement") is entered into between Strugglin' 2 Success: PeerLift Services LLC ("S2S") and the undersigned client ("Client").

1. PEER COACHING — NOT THERAPY OR MEDICAL TREATMENT
Client understands and agrees that Strugglin' 2 Success provides peer-led coaching, mentoring, and advocacy services. These services are not a substitute for licensed therapy, clinical counseling, or mental health treatment. S2S coaches are trained peer supporters — not licensed therapists, psychologists, psychiatrists, or medical professionals. Nothing provided through the S2S PeerLift platform constitutes clinical treatment or medical advice of any kind.

2. RELEASE OF LIABILITY
Client releases, waives, discharges, and covenants not to sue S2S, its members, managers, officers, employees, agents, successor coaches, and assigns (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Client as a result of or in connection with coaching services, peer support sessions, or any content accessed through the S2S PeerLift platform.

3. HOLD HARMLESS
Client agrees to hold harmless, defend, and indemnify the Released Parties against any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Client's participation in coaching or peer support services; (b) Client's reliance on any information or guidance provided by a coach through the platform; (c) any act or omission of a coach; or (d) any decision Client makes based on content accessed through S2S.

4. ASSUMPTION OF RISK
Client acknowledges that participation in peer support and coaching involves inherent risks and benefits, and Client voluntarily assumes all such risks. Client is encouraged to seek licensed professional support as needed in addition to peer coaching.

5. PHOTO & MEDIA RELEASE
Client consents to their image, name, and testimonial being used for promotional purposes by Strugglin' 2 Success. This may include use on the S2S website, social media, marketing materials, and public communications. Client may withdraw this consent at any time by emailing founder.peerliftservices@gmail.com.

6. HIPAA-ALIGNED PRIVACY NOTICE
S2S collects personal information including name, email, phone, session notes, and progress data. This information is used solely to provide coaching services, track client progress, and communicate with clients. S2S does not sell or share personal health information with third parties for commercial purposes. Client data is stored securely and accessible only to the Client's assigned coach and authorized S2S staff.

7. GOVERNING LAW
This Agreement shall be governed by the laws of the state in which S2S is incorporated. Any disputes arising from this Agreement shall be resolved in the appropriate state or federal courts of that state.

S2S PEERLIFT PRIVACY NOTICE

Strugglin' 2 Success: PeerLift Services LLC ("S2S") is committed to protecting your privacy. This notice describes how we collect, use, and safeguard your personal information.

Information We Collect
We collect personal information you provide directly, including: name, email address, phone number, session notes, journal entries, program progress, and any content you submit through the platform. We may also collect usage data such as pages visited and features used to improve our services.

How We Use Your Information
Your information is used to: (a) provide and manage your coaching services; (b) match you with peer support coaches; (c) communicate with you about your sessions and account; (d) generate AI-assisted session notes and progress reports (with your consent); (e) send you relevant resources and program updates. We do not use your personal information for advertising.

Data Sharing
S2S does not sell your personal information. Your session notes, progress data, and personal information are shared only with: (a) your assigned peer support coach; (b) authorized S2S staff members who need access to provide services; (c) third-party service providers (e.g., hosting, email) under strict confidentiality agreements. We may disclose information if required by law.

HIPAA Alignment
While S2S is not currently a covered entity under HIPAA, we voluntarily align with HIPAA standards to protect client privacy. Your session notes and personal health information are treated with the same care and confidentiality required by federal healthcare privacy laws. We maintain administrative, physical, and technical safeguards for all client data.

Data Security
Your data is stored on secure servers with encryption in transit (TLS) and at rest. Access is restricted to authorized personnel. In the event of a data breach affecting your information, we will notify you as required by applicable law.

Your Rights
You have the right to: (a) access your personal information; (b) request correction of inaccurate data; (c) request deletion of your account and associated data (subject to legal retention requirements); (d) opt out of promotional emails at any time. Retention
We retain your personal information for as long as your account is active and for a reasonable period thereafter to fulfill the purposes described in this notice. Data may be retained longer as required by law.

Children's Privacy
S2S services are not intended for individuals under the age of 18. We do not knowingly collect information from minors without verified parental consent.

Changes to This Notice
We may update this Privacy Notice from time to time. Any material changes will be communicated via email to the contact associated with your account. The date of the most recent revision is shown at the top of this document.
